TERMS AND CONDITIONS

By creating, provisioning, configuring or using a TourneyCommand tournament site, or by enabling any feature within it, you (“Organiser”, “you”) agree to these Terms & Conditions. If you do not agree, do not use the service.
1. What TourneyCommand is
TourneyCommand is a software platform that provisions and hosts a website and tools for running a golf tournament — registration, sponsorships, donations, payments, QR check‑in, live scoring, a big board, and optional add‑ons such as mulligans, contests, 50/50 draws and prize raffles. We provide technology only. We are not the organiser, promoter, operator, licensee or beneficiary of your event or of any draw, raffle, lottery or fundraiser you run using it.
2. Your account and eligibility
You are responsible for the accuracy of the information you provide, for the security of your login, and for all activity under your account. You confirm you are authorised to act for the organisation running the event.
3. Payments — your processor, your money
Payments are processed through your own Square account. You keep 100% of what you raise; TourneyCommand takes no percentage or transaction skim — only the platform fees you agreed to when you signed up. You are solely responsible for your Square account and its terms, for issuing refunds, for remitting any applicable taxes, and for the tax treatment and receipting of donations and fundraising proceeds. TourneyCommand does not hold, control or disburse your funds.
4. Raffles, 50/50 draws and games of chance — YOUR licence, YOUR responsibility
This section applies whenever you enable a 50/50 draw, prize raffle, or any other game of chance.
4.1 Licensing is yours. Running a raffle, 50/50 or lottery is a regulated activity. In Ontario and most jurisdictions it requires a licence or permit from the applicable provincial and/or municipal authority (in Ontario, the Alcohol and Gaming Commission of Ontario and/or your municipality). You are solely responsible for determining whether a licence is required, for obtaining and holding every required licence or permit before you sell a single ticket, and for complying with all conditions of that licence (ticket rules, prize limits, draw conduct, record‑keeping and reporting).
4.2 We are the technology, not the licensee. TourneyCommand provides software to help you run the draw. We are not the licensee, operator, promoter or conductor of any draw, and we do not provide gaming, legal or licensing advice. Nothing in the software constitutes a licence or authority to run a draw.
4.3 Venue confirmation. Where your event is held at a golf course or other venue, you are responsible for confirming and meeting any of that venue’s requirements relating to draws, alcohol, and on‑site fundraising.
4.4 The in‑product confirmation. When you enable a draw you tick a box confirming you accept these Terms. That confirmation, with its timestamp, is a record of your acknowledgement of this section.
4.5 Indemnity for draws. You will indemnify and hold harmless TourneyCommand and The Mad Hitter Inc. from any claim, penalty, fine or loss arising from a draw you run without the required licence or in breach of its conditions or applicable law.
5. Acceptable use
You will use the platform only for lawful tournament and fundraising purposes, will not misuse participants’ data, and will not attempt to disrupt, reverse‑engineer or gain unauthorised access to the platform.
6. Participant data and privacy
You are the party collecting registrant, sponsor, donor and volunteer information through your site. You will handle that information in accordance with applicable privacy law and our Privacy Policy at https://tourneycommand.com/privacy-policy/. TourneyCommand processes that data on your behalf to operate the service.
7. Hosting, availability and site lifecycle
We aim to keep your site available but do not guarantee uninterrupted service. Hosting and Server uptime can be seen in realtime here. Event features and site persistence follow the plan you selected. We may perform maintenance and updates. We retain your event records per your plan and do not hard‑ delete a charity’s records without notice.
8. Disclaimers and limitation of liability
The service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. TourneyCommand is not liable for indirect, incidental, special or consequential damages, for lost funds or lost fundraising, or for any matter arising from your draws, your licensing, your Square account, or your tax obligations. Our total aggregate liability for any claim is limited to the fees you paid to us for the event giving rise to the claim.
9. Indemnification (general)
You will indemnify and hold harmless TourneyCommand and The Mad Hitter Inc. from claims arising out of your event, your content, your use of the platform, or your breach of these Terms.
10. Suspension and termination
We may suspend or terminate access for breach of these Terms or unlawful use. You may stop using the service at any time; fees already paid are non‑refundable except as required by law.
11. Changes to these Terms
We may update these Terms; the current version is the one posted here with the effective date above. Continued use after an update means you accept it.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, and you submit to the courts of Ontario.
